1. Acceptance of Terms
By accessing or using the 4KAST website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and clients of 4KAST.
2. Services
4KAST provides IT infrastructure consulting, design, installation, and management services. The specific scope of services for each project is defined in individual statements of work (SOW) or service agreements. All service engagements are subject to these general terms unless specifically superseded by the project agreement.
3. Quotes and Pricing
Quotes provided through our website or sales process are estimates based on the information provided. Final pricing is confirmed in the signed statement of work. Quotes are valid for 30 days from the date of issuance unless otherwise stated. Prices do not include applicable taxes, permits, or fees unless explicitly listed.
4. Project Execution
4KAST will perform all services in a professional and workmanlike manner consistent with industry standards. Project timelines are estimates and may be affected by factors including but not limited to: client readiness, permit approvals, equipment availability, and site conditions. We will communicate any anticipated delays promptly.
5. Warranties
All installations include a minimum one-year workmanship warranty from the date of project completion. Equipment warranties are provided by the respective manufacturers and are passed through to the client. Extended warranty and maintenance packages are available and will be detailed in your service agreement.
6. Limitation of Liability
To the maximum extent permitted by law, 4KAST's total liability for any claim arising out of or relating to these terms or our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. 4KAST shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
7. Intellectual Property
All design documents, network diagrams, and other deliverables created by 4KAST for a specific project become the property of the client upon full payment. 4KAST retains the right to use general knowledge, techniques, and methodologies developed during the engagement. The 4KAST name, logo, and branding are trademarks of 4KAST.
8. Termination
Either party may terminate a service engagement with 30 days written notice. In the event of termination, the client shall pay for all work completed and materials procured up to the termination date. Ongoing support contracts may be cancelled with 30 days notice with no early termination fee.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these terms shall be resolved in the courts located in Miami-Dade County, Florida.
10. Changes to Terms
4KAST reserves the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
